PERM/I-140
An EB-2 I-140 builds upon the information in the certified PERM and speaks to NYU’s intent and capacity to employ the sponsored scholar in a permanent and full-time position.
It is possible to file an I-140 via premium processing an I-140; additional fees apply. Premium processing grants a decision within 15 calendar days of USCIS receipt.
While legally permissible to concurrently file for an I-140 and an I-485 (if the scholar’s priority date is current per that month’s Department of State Visa Bulletin), it’s recommended that the I-140 be approved before the I-1485 is filed. Concurrently filings risk issues with the I-140 that may negatively impact the I-485. Scholar Services is pleased to address specific questions in this regard.
