InterCEP Holds National Roundtable on the Legal Case for Preparedness

October 2006 -- The International Center for Enterprise Preparedness held a National Roundtable on the Legal Case for Preparedness in New York City on October 17, 2006. This Roundtable brought together general counsels from New York City and New York State from leading corporations, external counsels, industry associations, corporate preparedness experts, legal academia, and representation from the U.S. Department of Homeland Security.
InterCEP?s focus on the legal case for preparedness is to inform the development of actionable legal strategies for corporations to address operational risk and minimize potential post-crisis litigation costs.
This Roundtable successfully identified key issues and obstacles pertaining to corporate legal strategies for dealing with operational risks (including contractual and regulatory obligations, as well as standards of governance and care); discussed the importance of specific documenting preparedness activities as part of an affirmative defense strategy in anticipation of post-crisis litigation; explored the business value of conformance with existing, voluntary standards for organizational preparedness; and assessed the need for developing policy recommendations and research products based on the discussion proceedings.
