Separation

Separation from University employment may be due to a resignation, termination, or layoff due to lack of work or job abolishment. Your separation date is normally the last day you work.

Resignation

If you resign from the University, you must give at least four weeks’ notice. If you do not give adequate notice, you will not be eligible to receive pay for any unused vacation accumulation. A letter of resignation should accompany the notice.

Notice of Termination

If you have passed the probationary period and are terminated from the University for any reason except misconduct, you will receive four weeks notice or pay in lieu of notice.

Layoff and Severance Pay Plan Eligibility

To be eligible for severance pay, you must have completed one year of continuous, full-time permanent employment at NYU at the time of layoff.

Notice

If you have 10 or more years of service, you will receive a minimum of eight weeks’ notice (or pay in lieu of it) prior to layoff. If you have less than 10 years of service, you will receive a minimum of four weeks’ notice.

Severance Pay

You will receive one full week of pay per completed year of service for the first 10 years of service. For all completed years of service beyond 10, the formula is two full weeks of pay per year.

New Probationary Period for Employees Facing Layoff

To facilitate the transfer of someone facing layoff, an employee on layoff notice who is transferred to a new job in a different school or division will have a new probationary period. The new probation will be for performance review/grievance procedure purposes only. Seniority and benefits will remain continuous and in effect during this second six month probationary period. In the event the employee does not pass probation, he/she will still be entitled to the severance benefits due prior to the transfer, to be paid by the unit from which the employee was originally being laid off.

Transfer Fund

To further encourage the successful transfer of an employee facing layoff, the University funds up to $5,000 to bridge a salary gap in the event the employee's current salary is above that of the position into which he/she will transfer, providing that such a salary supplement does not create an inequity within the unit.

Career Counseling

An employee notified of layoff will be eligible at no cost for a four-part program of individual counseling sessions focusing on career and job search strategies, offered by the SCPS Center for Career and Life Planning. The University Employee Relations Office coordinates this employee service.

No Severance Pay

Employees are not entitled to severance pay if they leave the University under the following conditions:

  • Voluntary resignation
  • Discharge for cause
  • Disability covered by Workers’ Compensation or New York State Disability Insurance
  • Retirement

Unemployment insurance is a New York State Department of Labor program. All determinations of eligibility are made by the Department of Labor, Unemployment Insurance Division, according to the New York State Unemployment Insurance Law.
