Reinstatement and Prior Service Credit Policy - New York (PDF)

In accordance with the terms and conditions of this Policy, full-time Administrators and Professionals who were laid off or who resigned from NYU-New York (hereinafter, “former NYU-NY employees”), may be eligible for Reinstatement or for Prior Service Credit, as applicable, upon rehire as full-time Administrators and Professionals at NYU-New York (hereinafter, “covered positions at NYU-NY”).

DEFINITIONS


“Continuous service” includes leave time or other time off taken for any purpose recognized under University policy or applicable law, as well as any break in service recognized as continuous service under University policy or applicable law.

"Prior Service Credit" means that upon rehire into a covered position at NYU-NY, a former NYU-NY employee’s prior period of employment with NYU-NY will be counted towards the employee’s time of continuous service with NYU-NY, including for purposes of eligibility for benefits, unless otherwise provided herein or other NYU policy or plan. The employee’s break in service will not be counted towards the employee’s time of continuous service with NYU-NY.

“Reinstated” or "Reinstatement" means that a former NYU-NY employee’s original hire date with NYU-NY is restored upon rehire into a covered position at NYU-NY as if there had been no break in service, including for purposes of eligibility for benefits, unless otherwise provided herein or other NYU policy or plan.

ELIGIBILITY


To be eligible for Reinstatement or Prior Service Credit, a break in service cannot be greater than 12 months, and the former NYU-NY employee’s initial prior period of employment with NYU-NY must have been for a minimum of one year of full-time continuous service.

CREDITING OF SERVICE – FORMER NYU-NY EMPLOYEES REHIRED INTO COVERED POSITIONS AT NYU-NY


Former NYU-NY employees rehired into covered positions at NYU-NY are eligible for Reinstatement or Prior Service Credit as set forth below:

*Where the former NYU-NY employee is not rehired into the same job as he or she previously held at NYU-NY, he or she will be subject to a new probationary period for performance review purposes.

**In order to receive Prior Service Credit, a former NYU-NY employee must complete a year of full-time continuous service in the covered position at NYU-NY.


OTHER UNIVERSITY POLICIES


Please take note that this Policy does not supersede any other NYU policies or plans with specific provisions on reinstatement or prior service credit. Where provisions on reinstatement or prior service credit in any other NYU policy or plan conflict with the definition of Reinstatement or Prior Service Credit under this Policy, the provisions in the other NYU policy or plan will govern. For instance, retirement plan or retiree medical plan eligibility is based solely on the provisions of the applicable plan rather than this Policy.

RESPONSIBILITIES


The HR Officer, Director HR or HR Business Partner must initiate any requests for Reinstatement and Prior Service Credit or direct any questions under this Policy to the University Human Resources’ Assistant Vice President – Employee Relations.
