Popular Sovereignty and the Crisis of German Constitutional Law is a historical analysis of competing doctrines of constitutional law during the Weimar Republic. It chronicles the creation of a new constitutional jurisprudence both adequate to the needs of a modern welfare state and based on the principle of popular sovereignty. Peter C. Caldwell explores the legal nature of democracy as debated by Weimar's political theorists and constitutional lawyers. Laying the groundwork for questions about constitutional law in today's Federal Republic, this book draws clear and insightful distinctions between strands of positivist and anti-positivist legal thought, and examines their implications for legal and political theory. Caldwell makes accessible the rich literature in German constitutional thought of the Weimar period, most of which has been unavailable in English until now. On the liberal left, Hugo Preuss and Hans Kelsen defended a concept of democracy that made the constitution sovereign and, in a way, created the "Volk" through constitutional procedure. On the right, Carl Schmitt argued for a substantial notion of the "Volk" that could overrule constitutional procedure in a state of emergency. Rudolf Smend and Heinrich Triepel located in the constitution a set of inviolable values of the political community, while Hermann Heller saw in it a guarantee of substantial social equality. The introduction of state planning and party dictatorship dramatically altered the environment for social theory in the German Democratic Republic. But social thought did not disappear. By the mid-1950s, East German social theorists discovered the basic contradictions of state socialism that would eventually lead to its collapse: the inability of the plan to function without markets and its inability to permit markets the inability of the party-state to guarantee the rule of law and yet also the need for a regular system of rules in a modern industrial society and the contradictory philosophical claims of a Marxist-Leninist philosophy that rejected idealism, and Marxist-Leninist dogma with its idealistic claim to know the laws of social modernization. Making use of newly-available archival sources, Caldwell examines the articulation of these analyses, their subsequent suppression by party authorities in the late 1950s, and their return under the guise of cybernetics in the 1960s.

Romancing the Cathedral explores the late-nineteenth-century French passion for Gothic architecture, particularly the cathedral. Though maligned in the seventeenth and eighteenth centuries and vandalized during the French Revolution, by World War I the cathedral was considered "the genius of the French nation," a privileged and patriotic work of art that surpassed such other national artworks as Wagner's operas and the Parthenon. The major aim of this work is to analyze the forms involved in creating the Roman image and to explore its functionality within the given poetic system. In addition to formal analysis the background and the stimulus leading to the writing of a particular poem were explored. Legends and myths referring to known personalities, or toponims, were examined in perspective of their original version and other prominent interpretation.
Another objective of this exegesis was to evaluate how the images of Rome evolved with the development of Symbolists poetics. In the process of determining the vertical development of the Roman theme in the work of every poet the horizontal link to other recurrent themes within the poetics of the particular poet is demonstrated.
The Russian Symbolist poets committed to the city poetry found in Rome a perfect metaphor. In this context the relation between the Roman and Petersburg texts of the Russian literature is established. At the same time other notions pertinent to the Roman theme were exposed, among them the idea of eternal city, of the pax romana, with a formidable attention paid to the urban myth and the idea of universalism.

My book describes my innovative approach to weight maintenance called “Defensive Eating” whereby individuals are utilizing behavioral patterns on a maintenance basis. This obviously includes physical activity patterns, eating style patterns, and nutritional patterns that are all catered to the life-style for the individual. In a single sentence conclusion of my book, “Doing a diet is not enough, one must live a diet”. Ninety seven percent of patients who are obese have successfully done a diet at sometime in their life but less than five percent have kept the weight off for more than two to three years. Therefore the ultimate modality for the treatment of obesity must involve individualization of therapy addressing behavioral patterns, exercise, and life-style patterns. People must be taught the all-important feature of “defending their weight off”. My book is used in my Thinderella Lifestyle Change Program- a "turn-key" weight management program in my NYC office.

In most terrestrial and aquatic habitats, the vast majority of animals transmitting and receiving communicative signals are arthropods. This book presents the story of how this important group of animals use pheromones, sound, vibration, and light for sexual and social communication. Because of their small to minute body size most arthropods have problems sending and receiving acoustic and optical information, each of which have their own severe constraints. Because of these restraints they have developed chemical signaling which is not similarly limited by scale. Presenting the latest theoretical and experimental findings from studies of signaling, it suggests that close parallels between arthropods and vertebrates reflect a very limited number of solutions to problems in behavior that are available within the confines of physical laws.

In 1906 Manuel Hadida convened a meeting of eleven Jews in his parlor. A relative of his had passed away. The purpose of the gathering was to establish a synagogue and Jewish burial ground for the one hundred or so "Hebrew settlers" in Cuba. At another meeting not long afterwards officers were elected, but in the Fall 1906 the newly elected treasurer also died. From this auspicious beginning, the Cuban Jewish community reached 15,000 or more members at its zenith.
This book traces the history of that community, reconstructing many events which have been forgotten. The island's first rabbi made trips to Santiago de Cuba and Havana from Florida, where he owned an ice cream factory. During World War II kosher meat was slaughtered in Cuba for soldiers in the U.S. Army. Meyer Lansky, known for his underworld activities, applied for membership in a Havana synagogue.
The book also brings new understanding to more well-known history. The refusal of the Cuban government to allow the St. Louis to disembark passengers is examined in light of the flight of Jews from Nazi Europe, particularly to Mandate Palestine, where British immigration policy was changing (unknown to the Cubans). The building of new synagogues on the eve of the Revolution is considered in the context of nouveau riche and the move to suburbia.

The book follows the history of medicine and medical discovery as a means to doing so. Of course, there are dangers inherent with all forms of in-depth research.

The Dream of the Perfect Child is a historic and cultural journey from the “Perfectibility of Man” in the 18th century to the “perfect child” today. As science, medicine, technology, and cultural beliefs intersected at specific historic moments, Condorcet’s egalitarian vision gave way to the elitist, selective goals of the positivists, Social Darwinists, and eugenicists, who, pursuing the “perfect race,” misapplied science to reproductive practices to label and eliminate the imperfect. Although subsequently discredited, negative eugenics reemerged at mid-20th century as the unlocking of the genetic code combined with prenatal diagnosis technologies to produce tools for negative genetics to enter reproductive medical practice, and for the discourse of the perfect child to emerge. As individual decisions in the doctor’s office add up to rejecting the imperfect child with birth defects as unacceptable, and certifying the accepted, wanted child as near to perfect, medical practice conflates healthy and perfect, distorting parents’ hopes and fears. The nightmare of the “defective” child haunts and fuels the decisions, reinforcing centuries-old negative attitudes toward people with disabilities. Among critiques of the discourse of the perfect child, the least effective are those of bioethicists who fail to raise significant issues and support the status quo. More effective are counter-voices closer to reproductive practice: medical professionals, pregnant women, disability advocates, and feminists, who suggest frameworks for alternative discourses. The aim is not to reject technology, but to enlist it to transform the dream: for every child to be born healthy and wanted, accepted in all its uniqueness and diversity.

Plans to reform Social Security are as plentiful, and to most people about as welcome, as Christmas fruitcakes. But public political discussion of Social Security reform has emphasized bland and close to meaningless abstraction. This book provides a clear picture of the issues posed by Social Security reform. To explain such abstractions as "the Social Security system" and "privatization," it
s them down into their salient parts, and conceptually integrates them with the surrounding fiscal and economic landscape.
Thus, Social Security is essentially a 3-part program that (1) mandates forced saving by participants, (2) limits their portfolio choice, and (3) transfers lifetime wealth in various ways, such as from high-earners to low-earners and from single or two-earner households to one-earner married households. Privatization is essentially an arbitrarily assembled compilation of the following three conceptually distinct policy changes: (1) increase the system’s advance funding in the hope that this will correlate with increasing national saving (2) increase participants' portfolio choice within Social Security system, and (3)
eliminate redistribution through Social Security, whether between generations or from high-earners to low-earners within a generation. Different people may favor none,
some, or all of these distinct changes to the current system.
While the book closes with a brief sketch of a proposal that might be called progressive privatization, its main aim is to permit discussion of Social Security reform in terms of its fundamental allocative and distributional effects rather than in terms of mere symbolism or bookkeeping conventions.

I wrote this book in an effort to describe the actual enforcement operations of the INS inside the United States. I continue to research the topic and hope to update the material with special emphasis on criminal aliens in the United States. Interestingly, nothing much has changed since I did my original research. The government and the public rely on media reports about Mexican border crossers. There is little attention to the fact that millions of illegal aliens freely operate inside the United States, and the INS does little to enforce the laws on the books regarding this problem. The book is important because it presents an insiders view of enforcement operations at INS, especially with regard to the Special Agents. We know a great deal about the Border Patrol, and this book sheds some light on interior enforcement compared with the apparent misconceptions.

This study utilizes the perceptions of criminal investigators of the Immigration and Naturalization Service (INS) to describe the normative structure of an organization in its social context. The legacy INS attempted to provide both a service and control function. This dual mandate made it difficult for INS investigators to fulfill their mission of interior enforcement of the immigration laws. Other problems included organizational relations, as well as notions about professionalism, which affected recruitment, retention, training, and worker expectations. On March 1, 2003, the INS separated its dual mandate and moved to the Department of Homeland Security (DHS) with the intent of solving some of these problems. As a result, one might assume that the fundamental contradiction imposed by the dual-mandate structure would be resolved. The updated material in this edition discusses that prospect and includes statistical analyses of a sample of apprehended aliens, as well as the Survey of Inmates from the Bureau of Justice Statistics for information on foreign-born criminals. The data file on apprehended aliens is available for download for purchasers of the book. Current interior enforcement strategies are discussed in an interview with the Special Agent in Charge of the New York DHS office.
